Terms of Service

This Story Of Ours provides a personalized couples website creation service. You provide us with content (photos, text, quotes, and other details), and we build, host, and deliver a custom website on your behalf. The Service is offered in two plans:

• Starter Plan ($5.49/month): A personalized website hosted on a subdomain of thisstoryofours.com. Your subscription renews automatically each month. Cancel any time — your site remains live through the end of your current billing period and is taken offline when the subscription ends.
• Premium Plan ($12.99/month): A personalized website hosted on a custom .com domain that we provision and manage on your behalf. A one-time setup fee of $12 is added to your first invoice to cover domain registration costs. Your subscription renews automatically each month at $12.99. Cancel any time — your site remains live through the end of your current billing period.

Add-ons (additional photo slots, milestones, marquee phrases, or spotlight sections) may be purchased at checkout or through the customer portal at the prices shown at the time of purchase.

All prices are in US dollars. Payment is processed securely by a PCI-compliant payment processor. By submitting your order, you authorize us to charge the total amount shown at checkout to your payment method.

For all plans, your subscription renews automatically each month and your payment method on file is charged the applicable plan amount. For Premium plan customers, your first invoice includes a one-time $12 setup fee. By completing your purchase, you authorize this recurring monthly charge. You can cancel at any time through the billing portal in your Customer Portal.

All sales are final. Because we begin building your site immediately upon payment confirmation, we do not offer refunds except in the limited circumstances described in Section 9.

You are solely responsible for all content you submit, including photos, text, quotes, and other materials ("Your Content"). By submitting content — whether during the initial order form, through the customer portal, or at any other time — you represent and warrant that:

• You own or have the right to use all content you submit
• Your content does not infringe the intellectual property, privacy, or other rights of any third party
• You have obtained consent from any identifiable individuals depicted in your photos
• Your content complies with all applicable laws

We are not responsible for errors, inaccuracies, or omissions in content you provide at any stage, including during the initial order form, content update sessions, or portal submissions. You are responsible for reviewing all content before submitting it.

You retain ownership of Your Content. You grant This Story Of Ours a limited, non-exclusive license to store and display Your Content solely for the purpose of providing the Service. This license terminates when your site is taken offline.

Content Standards: We reserve the right to refuse, remove, or take offline any content or website that we determine, in our sole discretion, violates these standards or applicable law. Prohibited content includes but is not limited to: sexually explicit material (including nudity), content depicting or promoting violence, hate speech, harassment or defamation of any individual, content that infringes third-party rights, and any content that is unlawful. Violations may result in immediate removal of your site without refund.

For Premium plan customers, we provision and manage a .com domain on your behalf as part of the Service. You understand and agree that:

• The domain is owned and registered by This Story Of Ours and managed entirely by us. You are purchasing the right to use that domain as the address for your site for the duration of your active subscription.
• The domain is not transferable to you or to another registrar. When your subscription ends for any reason, the domain will be released or retired at our discretion.
• Domain availability is verified before order completion. In the extremely rare event that your chosen domain becomes unavailable during processing, we will contact you by email to arrange a full refund.
• We are not responsible for any consequences arising from domain unavailability or from changes to domain registration policies by regulatory bodies.

We aim to have your site live within 30–60 minutes of payment confirmation in most cases. Delivery may take longer in exceptional circumstances. We will notify you by email when your site is live.

The final appearance of your site may differ slightly from template previews shown on our website due to the unique nature of your content. We do not guarantee pixel-perfect replication of any preview. We are not responsible for the visual outcome of content choices made by you, including photo quality, text length, or other creative decisions.

After your site is live, you may access a customer portal to make content updates and purchase add-ons. Portal access is provided via a secure login link sent to your registered email address.

We are not responsible for content errors introduced at any point — including during the initial order, during portal updates, or otherwise. You are solely responsible for reviewing and approving the content you provide.

Premium plan customers receive a Story Refresh every four months, which adds additional content slots automatically. These credits do not roll over if unused.

Subscriptions renew automatically each month. You can cancel at any time through the billing portal in your Customer Portal. Your site will remain live through the end of your current paid billing period and will go offline when the subscription ends.

Your subscription renews automatically each month. Your card on file is charged without prior notice — it is your responsibility to ensure your payment method remains current.

You may cancel at any time through the billing portal in your Customer Portal. Cancellation takes effect at the end of your current paid billing period — your site remains live until that date and is taken offline when the period ends. No refunds are issued for unused portions of a paid period.

If an automatic payment fails, Stripe will retry the charge automatically. If all retry attempts are unsuccessful, you will be notified by email and your site may be suspended. If payment is not recovered, your site will be taken offline and all associated content permanently deleted. We are not liable for any loss arising from a site being taken offline due to non-payment.

For Premium plan customers: when your subscription ends for any reason, the custom domain registered on your behalf will be released or retired at our discretion. The domain is not transferred to you.

You may not use the Service to create or host content that is illegal, defamatory, discriminatory, harassing, or sexually explicit; to infringe third-party intellectual property or privacy rights; to upload malicious code; to resell or sublicense the Service without our written consent; or to misrepresent your identity. Violations may result in immediate suspension without refund.

All sales are final. We will issue a full refund only in the following circumstances:

• Your site is not delivered within 72 hours of payment and we are unable to resolve the issue
• Your chosen domain is unavailable during processing and we cannot complete your order
• A technical error on our part results in a duplicate charge

We do not offer refunds for change of mind, dissatisfaction with the template aesthetic after delivery, or content errors made by the customer at any stage. Refund requests must be submitted within 7 days of delivery to hello@thisstoryofours.com.

The This Story Of Ours brand, website, templates, and all associated design work are our intellectual property. You may not copy, reproduce, or distribute our templates or website design. Your website, built using our templates with Your Content, is for your personal non-commercial use only.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THIS STORY OF OURS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF CONTENT, LOSS OF A DOMAIN NAME, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

We aim to maintain continuous availability of your site but do not guarantee uninterrupted access. We are not liable for loss arising from service interruptions beyond our reasonable control.

These Terms are governed by the laws of the United States and the State of Delaware. Any dispute shall first be attempted informally by contacting us at hello@thisstoryofours.com. If informal resolution fails, disputes shall be submitted to binding individual arbitration under American Arbitration Association rules. You waive any right to participate in a class action.

We may update these Terms from time to time. We will update the "Last updated" date at the top of this page when we do. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
